1. PARTIES OF THE CONTRACT
1.1. BUYER

2. SUBJECT OF THE CONTRACT
Thesubject of thisContract is todeterminethemutualrightsandobligations of thePartieshereto as pertheprovisions of theAct on theProtection of theConsumersandtheRegulation on DistanceSalesContracts as well as allotherapplicableregulationsandapplicationsrelatedtothesales/ purchaseanddelivery of theproduct(s) withthebelowstatedpropertiesandthesalespriceorderedbythe BUYER viatheelectronicenvironmentviathewebsite www.jorahcloset.comof the SELLER.
3. PRODUCTS SUBJECTS TO THE CONTRACT
Products :Thetype, quantity,color, salesprice of theproductsare as chosenandverifiedbythe BUYER fromtheSELLER’sproductrange.
Paymentterms: Transferred as cashthrough bank accountorwithcreditcard.
The BUYER, based on thefactthatthetermsalesmay be conductedonlythroughcreditcardsissuedbythebanks, agrees, declaresandundertakesthat it shallconfirmtheinformationrelatedtotheinterestratesanddelayinterestswiththe bank separately, thattheprovision on theinterestpaymentsanddelayinterestsshallapplypursuanttothecreditcardcontractbetweenthe Bank andthe BUYER. Ininstallmenttransactionstheprovisions of thecontractconcludedbetweenthe BUYER andthe bank issuedtherelevantcardshallapply. Thepaymentdatesforthecreditcardshallalso be determinedbetweenthe bank andthe BUYER as pertheiragreement. The BUYER is entitledtofollowthenumber of installmentsandpaymentsthereof on theaccountsummaryto be sent bythe bank.
Delivery address: Theaddressspecifiedbythe BUYER.
The Product(s) will be deliveredtotheaddressstatedbythe BUYER duringcheck-outprocess on theSELLER’swebsite. Evenifthe BUYER will not be present at thedelivery time, the SELLER will be deemed as it has performeditsobligationshereunderfullyandcompletely. Therefore, anyandalllossesanddamagesduetothelatereceipt of theproductbythe BUYER, anydelay in thedeliverythereofattributabletothecargocompanyand/ orthereturn of theproducttothe SELLER shall be solelyincurredbythe BUYER.
Deliveringparty: Thechosencargocompany
Invoiceaddress: Theaddressspecifiedbythe BUYER.
Cargo Fee: Cargo fee is paidbythe SELLER forthedomesticshipmentswithinTurkey. Fortheinternationalshippings, theadditionalshipping rate calculatedbased on thedestinationcountrywill be displayedduringcheck-outprocess.
4. GENERAL CONDITIONS
4.1. Allsalesaremadetopersonsovertheage of 18. Personsunder 18 needtohavetheinvolvement of a parentorguardian.
4.2. The BUYER acceptsshe/he has knowledgebyreadingaboutthebasicspecifications of theproduct, salespriceandpaymenttermsandgivesconfirmation in electronicenvironment.
4.3. Theproductsubjecttothecontractshall be deliveredtothe BUYER ortotheperson/company in theperiodclaimed in the general terms not exceeding 30 daysbased on thelocationwherethe BUYER is located.
4.4. Ifthedelivery is addressedtothirdpartyotherthanthe BUYER, the SELLER is not responsiblefornon-acceptance of thedelivery.
4.5. The SELLER is responsible is deliveringtheproduct in questionunharmed, completeand as specified in theorder.
4.6. Forthedelivery of theproduct, thiscontractshould be electronicallyacceptedbythe BUYER andthepaymentshould be done bythe BUYER as chosenaccordingly. The SELLER is not responsiblefordeliveryifthepayment is not done orcancelled in bank records.
4.7. Afterthedelivery of theproduct, iftheBUYER’screditcard is usedillegallybythirdpartieswithouttheBUYER’sknowledgeandthusthe bank refuseto pay theamounttothe SELLER, the BUYER has toreturnthegoodstothe SELLER withinthreedays. Inthiscase, allcargocostsbelongtothe BUYER.
4.8. The SELLER needtoinformthe BUYER if he cannotmakethedelivery of theproductwithinthespecifiedperiodduetoextraordinaryconditionslikenaturaldisasters, weatherconditionspreventingthedelivery. Inthiscase, the BUYER has therighttocanceltheorder, changetheproductor/andpostponethedeliverytilltheextraordinaryeffect is over. Incasethe BUYER cancelstheordertheamount of shoppingwill be paid in 10 days in cash at once.
4.9. Thiscontract is validafterthe “I readtheagreement, I accepttheterms” box is markedbythe BUYER.
5. DEFAULT AND LEGAL CONSEQUENCES
Ifthe BUYER will fail tomakeanypaymentrelatedtothetransactionsconductedwith a creditcard, he/shewill pay theinterestamountand be liableagainstthe bank pursuanttothecreditcardcontractconcludedbetweenhim/her andthe bank. Insuchcasethe Bank mayuseapplicable legal remedies; requesttherefunding of any legal expensesandattorneyfeesfromthe BUYER, andthe BUYER agreesto pay anylossesanddamagesincurredbythe SELLER duetothedelayedperformance of thedebtbythe BUYER, in anycase.
6. RIGHT OF WITHDRAWAL FROM THE CONTRACT
The BUYER is entitledtouse her/his right of withdrawalfromtheContractbydenyingtheproductswithoutany legal orpenalliabilityandwithoutanyjustificationthereforewithin 14 (fourteen) daysfromthedelivery of theproductsto her/himor her/his designatedperson/ entity, in thedistancesalescontracts. Foranyuse of right of withdrawal, it is requiredtosend a noticetothe SELLER withregistered mail withreturnreceipt, faxor e-mail within 14 days(fourteen), andtherelevantproductshould not be used as pertheprovisions of thearticle 6 herein.
Intheevent of usage of theright of withdrawal, It is requiredtoreturn;
• theinvoice; Iftheinvoice of theproductswasissuedto a legal entity/company, it should be returnedwiththereturninvoiceissuedbythereturningentity. Theorderreturnsissuedtotheentitiesshall not be completedwithoutsuch RETURN INVOICE.
• Thebox, allpackagecontentwithalltags, labels in place, hygienicprotectivepad (neverremoved) withoutanymissingitem.
The SELLER, within 14 daysfromthereceipt of thenotice of withdrawal, shall deliver the total priceandthedocumentsestablishingcommitment/ debt on the BUYER.
Ifanydecreasewilloccur in thevalue of theProductsforanyreasonattributabletothe BUYER orif it willbecomeimpossibletoreturnthe Product, the BUYER willindemnifythe SELLER in linewithitsdefault.
7. COURT IN CHARGE
Intheapplication of thiscontract, the Consumer RefereeCommitteeorthe Consumer Courts in SELLER orBUYER’slocationareauthorized.
Thiscontract is validafterthe “I readtheagreement, I accepttheterms” box is markedbythe BUYER.
